It is the responsibility of state parties to execute ICC arrest warrants, Karim Khan

Islamabad (News International/ Pakistan New News - 22nd Nov, 2024 ) The Prosecutor of the International Criminal Court (ICC) Karim Khan has appealed to all State Parties to the Rome Statute to implement the decision to issue arrest warrants for Israeli Prime Minister Netanyahu, former Defense Minister Yoav Gallant and Hamas leader Muhammad Ze'if.


He said that the decision of the court came on the basis of an impartial investigation and objective and verifiable evidence, which was also forensically examined.


This decision by impartial judges confirms that international humanitarian law must be upheld in all circumstances through a transparent and impartial judicial process.


The Court needs the cooperation of Member States in this situation and in all other situations falling under its jurisdiction.


In this regard, cooperation from non-state actors working for accountability and compliance with international law will also be welcomed.


He said he would seek the cooperation of all parties, including the Israeli and Palestinian states, so that his office can fulfill its responsibilities under Article 54 of the Rome Statute to investigate and convict or acquit someone.


Crimes against humanity and war crimes

Karim Khan said that based on the evidence presented by his office in the recent trial, the court has confirmed that there are reasonable grounds to believe that crimes under the Rome Statute have been committed in this case.


The court has ruled that there are reasonable grounds to believe that Hamas leader Muhammad Diab Ibrahim al-Masri (Muhammad Diaf) allegedly committed crimes against humanity and war crimes in Israel and the Palestinian territories.


Mohammed Zeif, as a high-ranking leader of Hamas’s military wing (the Izz ad-Din al-Qassam Brigades), is allegedly responsible for crimes against humanity in the form of murder, destruction, torture, sexual violence and other such acts, and war crimes in the form of murder, cruel treatment, torture, taking of people hostage, incitement, sexual violence and other such acts. Mohammed Zeif is also criminally responsible for ordering or instigating, jointly and severally with other elements, the commission of such acts.


In addition, the court stated that there are reasonable grounds to believe that Israeli Prime Minister Netanyahu and former Defense Minister Gallant allegedly assisted in the commission of crimes against humanity in the form of the use of starvation as a weapon of war, murder, torture and other inhumane acts. In addition, both were found guilty of war crimes in the form of deliberate attacks against the civilian population as civilian officials.


Karim Khan said that all people should focus on those responsible for international crimes in Israel and the State of Palestine. In his meetings with Israeli victims and families of those abducted from there, as well as victims in Gaza, he made it clear that the law exists for all people and that it aims to uphold the rights of all.


Commitment to action on international crimes

Karim Khan expressed deep concern about the increasing tensions in the Palestinian territories, the further reduction in humanitarian access there, and the growing allegations of international crimes in Gaza and the West Bank.


He said that his office is conducting an independent and impartial investigation into the situation facing the State of Palestine.


In this regard, additional steps are also being taken regarding the cases falling under the jurisdiction of the Court regarding Gaza, the West Bank and East Jerusalem.


The Prosecutor says that his office will continue to fulfill its responsibilities to fulfill the fundamental promise, which is the foundation of the Rome Statute, that all human lives are of equal value.
