ISLAMABAD (UrduPoint News International / Pakistan Point News - 25th Dec, 2024 ) : Morocco’s justice and Islamic affairs ministers on Tuesday outlined sweeping changes to the country’s family law.
The move aims to introduce more than 100 amendments to the current law, which will give women more rights in child custody and guardianship disputes and also veto polygamous marriage.
This is Morocco’s first review of its family laws in twenty years.
Morocco: Controversy over child marriage
Feminist activists have long been calling for a review of regulations governing the rights of women and children in the family. These demands include full equality in inheritance and child custody, as well as a complete ban on child marriage.
But the latest reforms do not seem to meet these demands, although they are intended to modernize the legal framework in controversial cases.
Why is child marriage still prevalent in Pakistan?
Justice Minister Abdellatif Ouhbi said, for example, that it would not abolish the Islamic-based inheritance principle that gives men double the share of women, but it would allow individuals to pass on any of their assets to their female heirs.
In addition, current laws allow children under 15 to marry in exceptional circumstances, but the amended law would raise the marriage age to 17, just one year below the general marriage age.
The king has yet to approve the amendments.
The measure was presented to the public after two years of consultations with civil society as well as judicial and religious parties.
The new legislation still needs to be approved by parliament and the king.
Ouhbi did not set a timeline for the amendments to come into force.

King Mohammed VI, who also serves as the country's highest religious authority, said the revised code should be based on "the principles of justice, equality, solidarity and harmony" and "to protect Moroccan families, along with Islamic principles and universal values."
King Mohammed VI's opinion will be final in any dispute over the new law.
