Islamabad (News International News - 17th December 2024) The Lahore High Court has declared the petition of PTI founder Imran Khan inadmissible in the case related to the claim for damages by Prime Minister Shehbaz Sharif. Justice Chaudhry Muhammad Iqbal delivered the decision reserved yesterday on Imran Khan’s petition. The trial court judge’s decision to summon the witnesses for cross-examination is upheld, and the decision not to summon Shahbaz Sharif in his personal capacity to record his statement is upheld.
The court remarked that the subordinate court can take the statement of a party in his personal capacity or through an affidavit. The court declared the petition of PTI founder Imran Khan against allowing the witnesses to give written testimony as inadmissible. It may be recalled that the decision was reserved yesterday on the petition of PTI founder Imran Khan in the case related to the claim for damages by Prime Minister Shehbaz Sharif being admissible.
Justice Iqbal Chaudhry heard the petition of the founder of PTI against the claim of Prime Minister Shehbaz Sharif in the Lahore High Court. The founder of PTI had challenged the decision of the court hearing the defamation claim. Imran Khan’s petition had taken the position that the trial court had allowed the witnesses to give written testimony in the defamation claim.
This decision of the trial court was contrary to the facts. The witnesses should appear in the courtroom and testify. The court was requested to declare the decision of the trial court null and void. The petition had taken the position that under the law, the person filing the defamation claim had to appear in the court himself to make a statement. The petitioner said that the trial court had rejected the objection of Shehbaz Sharif not appearing in person.
The petition had requested that the trial court’s decision not to summon Shehbaz Sharif in person be null and void. Later, Justice Chaudhry Muhammad Iqbal of the Lahore High Court had reserved the decision on the admissibility of Imran Khan’s petition. Earlier, PTI founder Imran Khan had challenged in the Lahore High Court the trial court judge's order to cross-examine witnesses in a Rs10 billion damages case filed by Prime Minister Shehbaz Sharif.
